Reporting DMCA Violations on Mr. Stu

What is DMCA?

The Digital Millenium Copyright Act (DMCA) was passed by Congress in October 1998. The purpose of DMCA is two-fold: it limits the liability of service providers whose users are infringing upon the copyright of others, and defines the procedures necessary to report such infringement.

Reporting a DMCA violation:

Should you discover that content on MrStu.com is infringing upon your copyright, you may file official notification of such infringement. Upon receipt of a valid notification, Mr. Stu will promptly take steps to disable access to the infringing material.

In order to be considered valid, a violation notification must include:

• An electronic signature (your full legal name) of a person authorized to act on behalf of the copyright holder;
• Identification of the copyrighted work claimed to have been infringed, in the form of the original URL of the image or work being infringed upon;
• Identification of the material that is infringing upon your copyright, with the URL on MrStu.com of the content;
• Information reasonably sufficient for Mr. Stu to contact you (a valid email address or telephone number);
• A statement that you in good faith believe that the material is not authorized for use in such a manner;
• A statement, made under penalty of perjury, that the information given is accurate and you are authorized to act on behalf of the copyright holder.

This notification must be sent in full to abuse@mrstu.com (Mr. Stu's Designated Agent under the DMCA) to be processed.

Please be aware that you could be liable for damages (which could also include attorneys' fees) if you materially misrepresent a claim that content is infringing upon your copyright. If you are not absolutely certain as to whether material present on MrStu.com infringes upon your copyright, for example, if it may be protected under exceptions to the copyright law, like fair use, it is strongly recommended that you contact an attorney prior to submitting any claim of copyright infringement.
